Condominiums Foreclosure Reform – In efforts to change the Florida Statute 718.116 which currently places the burden on condominium associations for additional assessments and maintenance fees due to foreclosures, Commissioner Libbin is making arrangements to visit the Governor’s office in Tallahassee on April 1 and 2nd.  He will present all of the resolutions we have received urging this change.  In addition, he has drafted a letter below that you may copy and send to the following elected officials if you wish to support this effort.  (To avoid a spam block, you may want to send it to a few at a time):  You may also fax it to Julio Robaina’s office: 850 488 3088 or Rudy Garcia’s office: 888 284 8594.

The letter you need to send…

Dear Elected Official,

I am writing to urge you to support House Bill 1397, sponsored by Representative Julio Robaina, and its Senate Companion Bill 2302 sponsored by Senator Rudy Garcia.

Representative Robaina’s bill is the only one that puts money into the hands of condominium associations at an early stage.  The bill helps prevent additional foreclosures brought about by special assessments levied to cover the budget shortfalls of the foreclosed units. 

House Bill 1397 further requires that all fees and assessments past due must be paid within 15 days of filing a foreclosure notice.  If the past due amount is not paid within the 15 days, the condominium association can request the court to dismiss the foreclosure, which should be done with prejudice. 

None of the other bills currently filed are as strong for the condominium associations and for each unit owner.

Therefore, I urgently request your support of Representative Robaina’s House Bill 1397 and Senator Rudy Garcia’s Companion Bill 2302.
